Welcome to SugarFlag. These Terms of Service ("Terms") govern your access to and use of the SugarFlag mobile application, website, and related services (collectively, the "Services").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Who We Are

2. Eligibility
You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you may use the Services only with the involvement and consent of a parent or legal guardian.
By using the Services, you represent that:
- you can form a binding agreement with us;
- you will comply with these Terms and applicable law;
- the information you provide is accurate and current.
3. Account Registration and Sign-In
To access some features, you may need to create an account.
You may create or access an account using:
- email and password;
- Sign in with Apple;
- Google Sign-In.
You are responsible for:
- maintaining the confidentiality of your login credentials;
- all activity that occurs under your account;
- notifying us promptly if you suspect unauthorized access or misuse of your account.
We may suspend or terminate accounts that violate these Terms, create security risks, or are used fraudulently or abusively.
4. Description of the Services
SugarFlag helps users scan food labels and receive information or analysis related to ingredients and added sugar.
The Services may include:
- image capture or upload for label scanning;
- text extraction from food labels;
- scan history and related saved results;
- subscription-based premium features.
We may improve, update, modify, suspend, or discontinue features of the Services at any time.
5. No Medical, Nutrition, or Professional Advice
SugarFlag is provided for informational purposes only.
The Services do not provide medical advice, diagnosis, treatment, nutritional counseling, or professional healthcare advice. You should not rely on SugarFlag as a substitute for qualified medical, dietary, or professional guidance.
Always consult a qualified healthcare professional or other appropriate professional before making decisions about your health, diet, or medical conditions.
If you have a medical emergency, contact a qualified medical professional or emergency services immediately.
6. User Content and Inputs
You may provide images, scan inputs, support messages, and other content through the Services ("User Content").
You retain ownership of your User Content. However, you grant SugarFlag a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and use that User Content solely as necessary to:
- operate and provide the Services;
- process scans and generate results;
- maintain service functionality;
- improve security, reliability, and support.
You represent that:
- you have the rights needed to provide your User Content;
- your User Content does not violate the rights of others or applicable law;
- your User Content does not contain malicious code or harmful material.
7. Acceptable Use
You agree not to:
- use the Services for unlawful, harmful, fraudulent, or deceptive purposes;
- interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems;
- reverse engineer, scrape, copy, or exploit the Services except as allowed by law;
- upload content that infringes intellectual property, privacy, or other rights;
- use bots, automation, or abuse patterns that impair normal operation;
- circumvent subscription, entitlement, access controls, or free-feature limits;
- create, delete, and recreate accounts in order to obtain repeated free scans, trials, promotional benefits, or other free usage not intended by us;
- misuse trial, restore, referral, or promotional mechanisms.
8. Subscriptions, Billing, and Auto-Renewal
Some features may require a paid subscription.
If you purchase a subscription through Apple:
- payment is charged through your Apple ID account;
- subscriptions may automatically renew unless canceled at least 24 hours before the end of the current billing period;
- renewal charges are handled by Apple according to Apple's billing rules;
- you can manage or cancel subscriptions in your Apple account settings.
If you purchase a subscription through Google Play:
- payment is charged through your Google account;
- subscriptions may automatically renew unless canceled at least 24 hours before the end of the current billing period;
- renewal charges are handled by Google according to Google Play's billing rules;
- you can manage or cancel subscriptions in Google Play settings or at play.google.com.
We may offer different subscription plans, promotional pricing, trial access, or feature bundles from time to time. Prices and availability may change where permitted by law.
Unless otherwise required by applicable law or platform policy, purchases are non-refundable once processed. Refund requests for App Store purchases are handled by Apple under Apple's rules and processes. Refund requests for Google Play purchases are handled by Google under Google Play's refund policies.
9. Account Deletion and Termination
9.1 Delete Account
You may request deletion of your account directly in the app using the available account settings.
When you request account deletion:
- we will begin deleting your account and associated personal data;
- deletion may take time to complete;
- some information may be retained where legally required, for security, fraud prevention, backup, dispute resolution, enforcement, or similar legitimate purposes;
- we may retain limited records, including privacy-protective identifiers derived from account information, to prevent fraud, abuse, repeated misuse of free features, or circumvention of restrictions.
If your subscription was purchased through Apple or Google Play, deleting your account does not automatically cancel your subscription. Subscription billing and cancellation are managed by Apple through your Apple account settings or by Google through Google Play settings.
9.2 Suspension or Termination by Us
We may suspend, restrict, or terminate your access to the Services if:
- you violate these Terms;
- we are required to do so by law;
- your use creates security, legal, or operational risk;
- we detect fraud, abuse, repeated misuse of free features, or attempts to evade our restrictions;
- we discontinue the Services or a relevant feature.
10. Intellectual Property
The Services, including the app, website, software, design, branding, text, graphics, logos, and other materials provided by SugarFlag, are owned by or licensed to us and are protected by intellectual property and other applicable laws.
Except for the limited right to use the Services under these Terms, no rights are granted to you. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from the Services except as expressly allowed by law or with our written permission.
11. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, share, and retain personal data.
12. Third-Party Services
The Services may rely on or interoperate with third-party services, including:
- Apple services, such as Sign in with Apple and App Store subscription systems;
- Google services, such as Google Sign-In and Google Play subscription systems;
- Google Cloud services, including Google Cloud Vision API and Vertex AI, for OCR, scan processing, scan analysis, and related app functionality;
- other third-party hosting, infrastructure, logging, analytics, and security providers.
We are not responsible for third-party services, websites, policies, or practices. Your use of third-party services may be subject to their own terms and privacy policies.
13. Service Availability and Changes
We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.
To the maximum extent permitted by law, we may modify, suspend, or discontinue any part of the Services at any time, with or without notice.
14. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.
We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and that the Services will be uninterrupted or error-free.
We do not guarantee that scan results, ingredient classifications, or added sugar information will always be complete, accurate, or suitable for your specific needs.
15. Limitation of Liability
To the maximum extent permitted by law, SugarFlag and its affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of the Services.
To the maximum extent permitted by law, our total liability for claims arising out of or related to the Services will not exceed the greater of:
- the amount you paid to us for the Services in the 12 months before the claim arose; or
- USD $50.
Some jurisdictions do not allow certain warranty disclaimers or limitations of liability, so some of the above may not apply to you.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless SugarFlag and its affiliates, officers, employees, contractors, and licensors from and against claims, liabilities, damages, losses, and expenses arising out of or related to:
- your use of the Services;
- your User Content;
- your violation of these Terms;
- your violation of applicable law or the rights of another person or entity.
17. Governing Law and Disputes
These Terms are governed by the laws applicable in the jurisdiction where SugarFlag is established, without regard to conflict of laws rules, unless otherwise required by applicable consumer law.
If a dispute arises, the parties will first try to resolve it informally by contacting info@sugarflag.com.
If informal resolution is not successful, disputes will be resolved in the courts having jurisdiction where SugarFlag is established, unless applicable law provides otherwise.
If you are a consumer, mandatory rights and protections provided by the laws of your country of residence remain unaffected.
18. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date and may provide additional notice where required.
By continuing to use the Services after updated Terms become effective, you agree to the revised Terms.
